Q & A: Non-Compete Agreements

I’m writing my employee handbook and was wondering if I can state that when an employee has terminated his employment, he is not allowed to work 10 miles from the salon for one year. Thanks for any information on this topic.
Marie

Hi Marie,

Yes, that is something that you can state. It’s called a “non-compete agreement.” Include the non-compete agreement in the handbook, and make sure that both you and the employee sign the page. Keep a copy for yourself, and give one to the employee. Best wishes for your new salon!

Hello,
I was intrigued by your non-compete form. In our state of Nebraska, the law states that non-compete clauses are not worth the paper that they are written on, and that a person has the right to work at his or her profession when and where they want when they leave a persons employer.
In this day and age where there are salons very close, or, if you will on every block, well, what can I say.
